Terms of Use
The short version
This summary is not part of the agreement and does not change the sections below. If the two ever conflict, the sections below control.
ZipAisle is not a store, and it does not sell groceries. It is not a price database either. It is an errand-runner you send out: when you enter a zip code and a shopping list and press go, you are asking ZipAisle to go and look at the same public grocery-store web pages you could open yourself, read the prices off them, and bring the answer back in one place so you can decide where to shop.
- Nothing happens until you ask. Each run is a specific errand you send it on, and your watch list is the one standing errand. ZipAisle does not go looking at stores on its own initiative.
- It only looks. It never signs in as you, never buys anything, never gives a store your name, email, or payment details, and never commits you to anything.
- What it brings back is a report, not a promise. Prices are read off store pages by automated software, they can be misread, and they can be out of date. The price at the shelf or at checkout is the real one.
- Sending it out needs an account; looking around does not. An account is an email address and a link we send you — there is no password. You can enter a zip code and build a list without one. You can delete your account yourself at any time.
- Every account gets a weekly allowance of searches at no charge, and a paid plan buys a bigger one. A search is one item checked for you; the allowance resets every Tuesday at midnight. Plus and Pro are monthly plans that renew until you cancel. You can cancel from your account page in one step, your plan runs to the end of the month you have paid for, and your first payment is refundable in full if you ask within 7 days. Section 9 has the details.
- If you have an account, we check your staples every Wednesday and email you the best prices. Your watch list is the items you have checked, or chosen to watch; the weekly check uses none of your searches, and one click in any of those emails stops them. Section 2 has the details.
1. Who these Terms are between, and what you are agreeing to
These Terms of Use (the "Terms") are a binding agreement between you and Vykka LLC, a Washington limited liability company ("we," "us," "our"), which owns and operates the ZipAisle website and service (the "Service"). ZipAisle is a service of Vykka LLC; where these Terms say ZipAisle did something, Vykka LLC is the party responsible for it.
A plain-language walkthrough of what the Service does on a run, and what it never does, is on the How ZipAisle works page. That page is a summary; these Terms are the agreement.
By using the Service — by entering a zip code, submitting a shopping list, asking for a sign-in link, creating or using an account, buying a plan, opening a saved plan link, or asking to be notified when a plan is ready — you accept these Terms. If you do not accept them, do not use the Service.
Eligibility. You must be at least 18 years old and located in the United States. The Service is offered for your personal, household, non-commercial use only.
Your account. Sending the Service out to check prices requires an account, which is an email address and nothing else: you sign in by clicking a link we email you, and there is no password at any point. Entering a zip code, building a list, and opening a saved plan link someone sent you require no account. Section 8.1 sets out what an account is and what you agree to in having one.
2. What the Service is
Starting a run requires you to be signed in (Section 8.1), and the weekly check described below is kept only for an account. Nothing else about what the Service does depends on your having an account. Each time you run it, it does the following, and only the following:
- Takes a zip code you type, or an approximate location your browser offers when you press “use my current location,” and uses it to identify grocery stores near you.
- Takes the list of grocery items you enter.
- On your instruction and on your behalf, visits the publicly available search pages of those stores' websites — the same pages, at the same public addresses, that you could open in your own browser — and reads what is displayed there: product names, sizes, and the prices the store is publishing to the general public.
- Converts those prices to comparable units (per ounce, per fluid ounce, per item) so that differently-sized packages can be compared fairly.
- Reports back to you: what each item would cost at each nearby store, which store offers the better value for each item once sizes are made comparable, and an estimated cart for your whole list at each store, in one stop or two. It reports value on unit price, not the smallest total — a best-value plan can cost more than shopping at a single store, and the results page says so where it shows both.
The weekly check. If you have an account, the Service also keeps a watch list for you: up to 15 of the items you have checked, or chosen to watch from a results page, each with the zip codes it is checked in. Every Wednesday morning it checks those items at the stores in their zip codes, on your behalf and in the same way as a run, keeps the result as a plan you can open, and — from your second weekly check — emails you a summary with a link to that plan. How many of the items you are shown each week depends on your plan (Section 9.1); the rest are checked too. The weekly check does not use your searches. You can remove items at any time, and stop the email with one click in any of those emails or on your watch list; stopping the email does not stop the check. A Free account that has not been signed in to, and whose watch list has not been opened, for 3 weeks is paused until you come back.
That is the whole of it. The Service does not sell groceries, hold inventory, take orders or payments for groceries, deliver anything, or act as a marketplace, broker, or reseller. It is not a party to any purchase you make, and it earns nothing from any purchase you make. The only thing we charge for is a paid plan, which buys a larger weekly allowance of searches (Section 9).
3. Your appointment of ZipAisle as your agent
This section is the heart of these Terms. It sets out what you are authorizing, what you are not authorizing, and what we owe you in return.
3.1 The appointment
You appoint ZipAisle as your limited, revocable, non-exclusive agent for the sole purpose of gathering publicly available grocery pricing information on your behalf, and you authorize us to act for you within the scope described in Section 3.2 and nowhere else.
The relationship these Terms create is the ordinary one between a principal and a limited agent: you are the principal, you decide what the errand is, and ZipAisle acts within the boundaries you have set. When ZipAisle visits a store's website in response to your request, it does so as your instrument and at your direction — the same act, in substance, as you opening that store's website yourself to check a price, carried out on your behalf because you asked for it.
3.2 Scope of the authority you are granting
Each time you run the Service, you authorize us, for that run, to:
- (a) identify grocery retailers with locations near the zip code or approximate location you provided;
- (b) visit the publicly accessible search and product-listing pages of those retailers' websites — pages that are open to any member of the public, that require no login, subscription, or payment to view, and that you would be free to visit yourself — sending each visit from our own servers or, at the retailer sites named on the How ZipAisle works page, through internet addresses we rent from a network provider, which are shared with its other customers, are not yours, and do not identify ZipAisle;
- (c) read and record from those pages the product information the retailer is publicly displaying — product name and description, package size, and price;
- (d) interpret and normalize that information, including by using automated and machine-learning tools, so that it can be presented to you in a comparable form;
- (e) retain that information for a limited period so that your plan can be shown to you, saved for you, and — where the same public price would otherwise be looked up again — reused rather than re-requested from the retailer, as described in Section 4.4;
- (f) where you have asked for it, hold the resulting plan at a link and send you one email telling you it is ready; and
- (g) while you have a watch list, hold each week’s plan for it at a link and, unless you have stopped the email, send you one email a week summarizing that plan — or telling you the check could not be completed — with a link to it and, where your plan shows fewer items than were checked, a sentence about the items it does not show.
For a run, this authority is exhausted when the run finishes. As your agent, ZipAisle visits a retailer's website only in response to an instruction you have given.
Your watch list is the one standing instruction. You give it when a run first fills your watch list, and you renew it with every run you make afterwards and every item you choose to watch: the items of each run are added to your watch list (Section 2). Each Wednesday's check, the plan it keeps and the email it sends are ZipAisle acting on that instruction, within the authority in (a) to (g) above, and not on its own initiative. You can withdraw the instruction, in whole or in part, at any time: remove items from your watch list, or delete your account. A later run that contains an item you removed adds it back, because that run is a new instruction. Stopping the Wednesday email withdraws the email and nothing else — the check continues until you remove the items.
3.3 What you are not authorizing, and what we will not do
To make the boundaries of the appointment explicit, ZipAisle is not authorized to, and will not:
- (a) log in to, create, access, or use any account of yours at any retailer, or use any credential of yours anywhere;
- (b) buy anything, add anything to a cart, place, modify or cancel any order, or spend or commit any money of yours;
- (c) enter into any contract, agreement, subscription, or membership in your name;
- (d) submit your name, email address, phone number, payment details, or any other personal information of yours to any retailer;
- (e) access member-only, loyalty, or personalized pricing, or any page, price, or content that is behind a login, paywall, or subscription;
- (f) negotiate on your behalf, make any representation on your behalf, or hold itself out to any retailer as having authority beyond reading public pages;
- (g) act for you in any matter other than gathering the pricing information described in Section 3.2; or
- (h) delegate this authority to anyone else except to the service providers we use to operate the Service (hosting, browser automation, machine-learning inference, and the network provider described in Section 3.2(b)), each of which acts only as our subcontractor for this same limited purpose.
If you ever see the Service doing any of the above, it is malfunctioning or being misused, and we ask you to tell us at hello@zipaisle.com.
3.4 What you are telling us when you send ZipAisle out
Each time you run the Service, you represent to us that:
- (a) you are a genuine consumer, using the Service to plan an actual shopping trip for your own household;
- (b) you are not using the Service to collect pricing data for resale, redistribution, publication, competitive intelligence, market research, or to build or supplement any database or product of your own;
- (c) the location you have given is one where you actually intend to shop, and you are not entering locations in order to survey pricing across markets;
- (d) no retailer whose site you are directing us to has told you that you may not access its website, and you are not under any court order, settlement, agreement, or ban that would make your own visit to that site improper; and
- (e) you are not directing the Service to do anything you could not lawfully do yourself.
These are not formalities. The legitimacy of what ZipAisle does on your behalf depends on the errand being a real consumer errand. If you cannot make these representations honestly, you are not authorized to use the Service.
3.5 What we owe you as your agent
Because we act as your agent, we accept the following duties to you, within the scope of Section 3.2:
- Acting on instruction. We will act only on the instructions you give and only within the scope you have granted, and we will not go beyond it.
- Loyalty in what we report. We will report what we actually found. We will not reorder, suppress, inflate, or discount results in exchange for payment or preference from any retailer, and we will not present a store as cheapest when our own results say otherwise. If we ever accept compensation that could affect what you are shown, we will disclose it clearly, in these Terms and on the results page, before you rely on it.
- Your list is yours. We will not sell your shopping list or your location, and we will not use them to build an advertising or behavioral profile of you, or for any purpose unrelated to producing the plan you asked for. See Section 8 and the Privacy Policy.
- Reasonable care. We will use reasonable care and skill in gathering and reporting the information — subject, importantly, to the accuracy limits in Section 5, which describe real limits of the technology rather than a disclaimer of effort.
- Records. We keep operational records of the runs we perform so that what the Service did on your behalf can be reconstructed if it is ever questioned.
The limits of this. These duties are the duties of a limited agent performing a defined informational errand. We are not your fiduciary for any other purpose; we are not your financial, nutritional, or purchasing adviser; and we owe you no duty to find the lowest price that exists, to cover every store, or to continue covering any store. Nothing in this Section 3.5 expands the scope of Section 3.2 or overrides Sections 5, 14, or 15.
3.6 Revoking the appointment
You may revoke the appointment at any time, for any reason. For a run, stopping your use of the Service is enough, and there is nothing to cancel and no notice to give: because the authority in Section 3.2 lasts only for the duration of a run, closing the page ends it. Having an account does not change this — an account is not a standing instruction to do anything, and a signed-in shopper who runs nothing has sent us on no errand. The one standing instruction is a watch list, which stopping your use of the Service does not end: you revoke it the way Section 3.2 says, by removing its items or by deleting your account. A paid plan does not change it either: a plan is a subscription to a larger weekly allowance, not a standing errand, and it is cancelled separately, in the way Section 9.4 describes.
You may also delete your account outright, at any time, from your account page (Section 8.1). To have a saved plan deleted before it expires on its own, or to withdraw a notification request, without deleting your account, contact us at hello@zipaisle.com.
We may also decline to act for you, or stop acting for you, at any time — including where we believe a use falls outside Section 3.4, where a retailer has asked us to stop (Section 4.3), or where the Service is being used in a way these Terms do not permit.
3.7 We are not the retailers' agent
The appointment runs in one direction only. ZipAisle acts for you. It does not act for, represent, or speak for any grocery retailer, and no retailer has appointed, authorized, endorsed, sponsored, or partnered with us. Nothing a retailer publishes on its own website becomes an offer to you through us, and nothing we report to you binds any retailer.
4. Retailers, their websites, and their terms
4.1 No affiliation
We are not affiliated with, endorsed by, sponsored by, or connected to any grocery retailer whose prices appear in the Service. Store names, logos, and product names are the trademarks of their respective owners, and we use them only to identify the store or product a price came from — a descriptive use, and not a claim of any relationship.
4.2 Public pages only
ZipAisle visits pages that are available to the general public without a login, without a subscription, and without payment. It does not use anyone's credentials, does not access member or loyalty pricing, and does not seek out content a retailer has placed behind a barrier to entry.
4.3 If a retailer asks us to stop
A retailer that does not want ZipAisle visiting its site on shoppers' behalf may tell us so, and we will honor that request. Retailers may write to hello@zipaisle.com from an address at their own domain, naming the domains they want excluded; the process is set out on the How ZipAisle works page. On receiving a valid request, we will stop directing the Service to that retailer's site and will remove it from the stores we cover, and we may do so without notice to you. This may mean a store you have relied on stops appearing in your results.
A written request under this section is how a retailer tells us to stop; we do not read robots.txt files or similar robots directives. Our visits to a retailer's site are sent from our own servers, except at the sites named on the How ZipAisle works page, which refuse the requests our servers send them: there, our visits are sent through internet addresses we rent from a network provider (for your errands, under Section 3.2(b)), never to reach anything behind a login, paywall or membership, and never to a retailer that has made a request under this section. Where a retailer's site refuses a page we ask for, that store is shown as not having answered, and we do not ask for that page from a different network address in the same run.
4.4 Reuse of prices between shoppers
You should understand exactly how the information flow works, because it is not purely one-to-one. When ZipAisle reads a public shelf price for an item at a store, it holds that price for a limited period (currently, until the start of the following week) and may show that same price to another shopper who later asks about the same item at the same store, instead of visiting the retailer's site again.
We do this deliberately and in both parties' interests: it means far fewer visits to the retailer's website than one-per-shopper would require, and it means you get an answer faster. It also means that a price shown to you may have been read on an earlier day, on another shopper's request, rather than in the moment you asked — which is one of the reasons Section 5 matters.
4.5 The retailer's own terms
Grocery retailers publish their own terms of use governing visitors to their websites. Those terms are between you and them, and between us and them; they are not ours to interpret for you and these Terms do not displace them.
You agree not to direct the Service to any retailer's website in circumstances where your own visit to that site would breach an agreement you have with that retailer. If you have accepted terms with a retailer that prohibit you from using automated means to access its site, do not use the Service for that retailer.
Nothing in these Terms is a representation by us that any particular retailer permits, or is required to permit, access of this kind — a point on which the law is unsettled and actively developing, and on which retailers hold their own views.
5. Accuracy: what the numbers we show you are, and are not
Read this section. It is the one most likely to matter to you.
The prices, sizes, product names, and totals the Service reports are our best automated reading of what a retailer was publicly displaying at a particular moment. They are informational estimates to help you choose where to shop. They are not offers, not quotes, not guarantees, and not a price you are entitled to.
Specifically, and without limiting Section 14:
- Automated and AI-based reading. Product listings are read from store web pages and interpreted using automated software including machine-learning models. That software can misread a price, pick the wrong package size, or match your list item to a product you did not mean — for example, returning organic milk when you meant conventional, or a two-pack when you meant one.
- Timing. A price may have been read up to about a week before you see it, and may have been read on another shopper's request (Section 4.4). Every price we show you carries the time it was read, so you can see for yourself how current any figure is. Retailers change prices, run and end promotions, and restock without telling us.
- What is excluded. Reported prices generally do not include sales tax, bottle or container deposits, bag fees, delivery, pickup or service fees, or tips. They generally do not reflect loyalty or member pricing, digital coupons you have clipped, manufacturer coupons, in-store-only promotions, clearance, or per-household purchase limits — several of which are exactly the things that can make a real bill differ from our total.
- Availability. That an item appears for a store does not mean that store's location near you has it in stock today, or in the size shown.
- Coverage. We do not cover every retailer near you, and we do not claim that the cheapest option we found is the cheapest option that exists.
- Unit comparisons. Normalized prices (per ounce, per fluid ounce, per item) are computed by us from package sizes we have read, and are meant for comparison. Where a normalized figure and a shelf figure disagree, the shelf figure is the one that will be charged.
The price at the shelf and at the register is the real price. Verify before you rely on it, and treat any plan the Service produces as a starting point for your trip rather than a bill.
You have no right to demand any price from a retailer because the Service displayed it. Retailers are not bound by anything shown here, and price-match decisions are theirs alone.
6. Automated decision-making and AI disclosure
The Service is automated end to end. Machine-learning models select which product on a store's page best matches each item on your list and extract its price. No human reviews the results before you see them.
We tell you this so that you can calibrate what you are looking at: the Service is a fast, wide-coverage first pass, and it makes the kinds of mistakes that automated matching makes. Where a result matters to you — an expensive item, an unusual size, a store you would drive out of your way to reach — check the store's own page or the shelf before acting on it.
7. Availability, changes, and coverage
The Service is provided on an as-available basis. Every account has a weekly allowance of searches at no charge, and a paid plan buys a larger one (Section 9); nothing else about the Service is charged for. We may change, suspend, limit, or discontinue any part of it — including coverage of any particular retailer, area, or feature — at any time and without notice. Saved plan links expire on their own; how long they last depends on your plan (Section 8.1). We do not guarantee that the Service will be available, complete, or uninterrupted, or that any store you have used before will still be covered the next time. Section 9.6 says what a change in coverage or an outage does, and does not do, to a paid plan.
8. Your account and your information
8.1 Your account
What an account is. An account is an email address. There is no password: when you want to sign in, you give us an address, we email you a link, and clicking that link and confirming on the page it opens signs you in. A link works once and lasts ten minutes. Asking for a new one retires the one before it.
What it is for. An account is required to send the Service out on a run, and is not required for anything else: you can enter a zip code, build a list, and open a saved plan link someone sent you without one. We use your address to sign you in; — only if you tick the box when starting a run — to send you one message linking to that finished plan; and, while you have a watch list, to send you the Wednesday email described in Section 2, which can tell you what a paid plan would show you and which you can stop with one click. If you write to us, by email from it or through the Service while you are signed in, our reply goes to it. We send you nothing else, and we do not add you to any other list.
It is personal to you. An account belongs to one person: you. You agree to use an email address you control, to keep access to that mailbox secure, and not to share your account or let anyone else use it. Anyone who can read your email can sign in as you, which is the trade a passwordless service makes, and it is the reason the mailbox matters. You must meet the eligibility requirements in Section 1 to hold an account.
Signing out. You may be signed in on more than one device at the same time; that is deliberate, so a plan built on a laptop is available on a phone in the store. Your account page lets you sign out of the device you are using, or out of every device at once. Sessions also end on their own: 30 days after they are last used, and in no case more than 180 days after you signed in.
Deleting your account. You may delete your account at any time, for any reason, from your account page. You do not have to ask us, give a reason, or wait. Deletion is immediate and it cannot be undone. It cancels any paid plan first (Section 9.4), then removes your account, the sign-in links ever issued to your address, every session on every device, and the plans you saved, and it cuts the link between you and the records of the price checks run for you. Those records — the zip code, the items, the prices we read and when — are kept without any identifier for up to 24 months and then deleted. The Privacy Policy sets out exactly what is removed, what is kept without your name on it, and the few things that are neither.
We may end an account. We may suspend or end an account at any time, with or without notice, including where we reasonably believe it is being used outside Section 3.4 or Section 10, where it is being used to evade a limit, or where we stop offering the Service (Section 7). We do not owe you an account. If we end an account that is on a paid plan, and we do so for a reason other than your breach of these Terms, we will refund the part of the current billing period you have paid for and not had.
What happens to saved plans. Saved plan links expire on their own, whatever else happens: after 7 days on the Free plan, after 90 days on Plus, and for as long as a Pro plan is paid for. A plan link made without signing in lasts 24 hours. When a paid plan ends, the plans saved under it are kept for at most 7 days from that date. If you delete your account, or we end it, the plans saved under it are deleted at that moment and their links stop working straight away — including links you have already sent to other people. If you want a plan to outlast your account or your plan, keep a copy of what it says rather than relying on the link.
8.2 What we do with your information
Our handling of your information is described in the Privacy Policy, which is incorporated into these Terms. In summary, and consistent with the duties in Section 3.5:
- Your email address. It is your account, and it is the only thing we ask you to tell us about yourself. We hold it until you delete your account. It does four jobs and no others: signing you in, sending you a plan link if you asked for one, replying when you write to us, and sending you the Wednesday watch-list email until you stop it.
- Your watch list. Up to 15 item names, each with the zip codes it is checked in, kept while your account exists and deleted with it (Section 2). The Privacy Policy says what the weekly check keeps and for how long.
- Sign-in links and the sign-in cookie. We keep a record of each sign-in link so that it can be used only once, and we store a one-way fingerprint of it rather than the link itself. Signing in sets one cookie, whose only purpose is to keep you signed in; ZipAisle sets no advertising or tracking cookies.
- Location. A zip code you type, or the approximate location your browser provides if you press “use my current location,” is used to find nearby stores. Browser location is requested only when you press that button, and you can decline.
- Your list. The items you enter are used to run your request and to produce your plan. If you ask for a sign-in link while building a list, the list travels with that link. Opened in the browser that asked for it, the run starts by itself; opened anywhere else, the list is shown to you and runs only if you choose. It is deleted when the link is used or expires.
- Your runs. We keep operational records of the runs performed for you (Section 3.5), including technical details of each request. The records of every run made while you are signed in, and of the runs a browser made before you were the first to sign in on it, are attached to your account rather than to an anonymous identifier. Deleting your account cuts that link: the records are kept without any identifier for up to 24 months, for working out how the Service is used and where it fails, and are then deleted.
- Saved plans. If you ask for a saved or shareable plan link, that plan is stored for the period in Section 8.1 — 7 days on Free, 90 days on Plus, while a Pro plan is paid for, and 24 hours if nobody was signed in — and then deleted automatically. Anyone who has the link can open the plan, including the zip code and the list it was built from, without signing in — so treat the link as you would any other private link and share it only with people you intend to. A plan link does not show your email address and gives no access to your account.
- Ratings and messages. If you rate a plan, or write to us through the Service, we keep the rating with the plan and forward what you write to the mailbox we answer from. What you write is erased from our database 90 days after we receive it; the rest of a rating or a message is kept, for counting, for up to 24 months. The Privacy Policy says exactly what is kept, where, and for how long.
- Your payment details. If you buy a plan, you pay on a checkout page run by Stripe, our payment processor. Your card number goes to Stripe and never to us; what we hold is Stripe's reference for you, which plan you are on, and when it renews. Section 9.2 and the Privacy Policy say exactly what Stripe receives.
- Please do not type personal information into item names. The item field is a grocery list, not a notes field; anything you put there travels with the plan. The same goes for a message to us: leave out health or financial details, card or account numbers, passwords, and anything about anyone else.
9. Plans, payment and cancellation
This section is the agreement for a paid plan. If you never buy one, the only part of it that applies to you is 9.1, which describes the allowance every account has.
9.1 The plans and the weekly allowance
What a plan buys is a weekly allowance of searches. A run checks your list in up to 3 zip codes at once, depending on your plan (the table below). A search is one item on your list checked for you in one run, counted once when at least one of the run's zip codes is new for that item this week; every zip code in the run is then recorded as checked for that item. An item we have already checked for you this week in every zip code of a run is not counted again, so re-running a saved list costs nothing and adding an item to it costs one search. A run that adds a zip code an item has not been checked in counts that item as one new search, however many of the run's zip codes are new. We count searches per account, never per browser or per device.
| Plan | Price | Searches a week | Zip codes per run and per watched item | Watch list items shown each week | Saved plans kept |
|---|---|---|---|---|---|
| Free | $0 | 15 for the first four weeks, then 10 | 1 | 1 | 7 days |
| Plus | $4.99 a month, plus applicable sales tax | 30 | 2 | 5 | 90 days |
| Pro | $9.99 a month, plus applicable sales tax | 75 | 3 | 15 | While your plan is paid for |
A new account's first four weeks. On the Free plan, an account gets 15 searches a week for its first four weeks — the week the account is created counts as the first, however late in that week you sign up — and 10 a week from the fifth week on. The paid plans' allowances do not change with the age of the account.
The allowance is weekly. It resets every week at midnight between Tuesday and Wednesday, Pacific time, and unused searches do not carry over. A paid plan is billed monthly, and a billing month holds four of those resets or five; you get every one of them. We do not sell, and these Terms do not promise, a monthly number of searches. Every plan has a cap, the Free plan included.
Running out. If a list needs more searches than you have left, we check as many items as you have searches for, in list order, tell you which items were not checked, and give you a plan for the ones that were. We never charge for a search we could not complete: an item is only counted when at least half the stores we asked answered for it, and a run that fails altogether is not counted at all.
What a plan is not. A plan does not change what the Service is (Section 2), what it will and will not do on your behalf (Section 3), which stores it covers (Section 7), or how accurate it is (Section 5). A paid plan does not buy a promise that any particular store will be available, that any price will be current, or that any lookup will succeed.
9.2 Paying, and automatic renewal
Plans renew automatically. Plus and Pro are monthly subscriptions. When you buy one, you authorize us to charge the payment method you give us the plan's monthly price, plus applicable sales tax, every month on the day of the month you signed up, until you cancel. The price, the tax, the monthly cadence and the fact that the plan renews until you cancel are all shown on the checkout page before you pay, and you agree to them there. You can cancel at any time in the way Section 9.4 describes, and cancelling stops every future charge.
Who takes the payment. Payments are taken by Stripe, our payment processor, on a checkout page and in a billing portal that Stripe runs. Your card number is given to Stripe and never reaches us. Stripe also asks for a name and a billing address, which it needs to charge the card and to work out sales tax; those are held by Stripe. The charge appears on your statement as ZIPAISLE. The Privacy Policy says exactly what Stripe receives and what we get back from it.
Your payment method. You may only use a payment method you are authorized to use. If a charge fails, Section 9.5 applies. You are responsible for keeping your payment details current, which you can do from the billing portal reached from your account page.
Sales tax. Prices are stated before sales tax. Where a sale is taxable — which, for a digital service sold by a Washington business, includes every sale to a Washington address — the tax is worked out from your billing address, shown as its own line on the checkout page before you pay, and added to each monthly charge. If your billing address changes, the tax follows it.
When a plan starts. Your new allowance applies from the moment the payment goes through, to the week already in progress; searches you had already used that week are still used. We do not shorten or prorate the first week.
Changing plans. You can switch between Plus and Pro from the billing portal. Moving up takes effect straight away, and you are charged the difference for the rest of the current billing period. Moving down takes effect at the end of the current billing period, and until then you keep what you paid for.
Price changes. If we change the price of a plan you are on, we will email you at least 30 days before the new price applies, and it will apply from your first renewal after that date. If you do not want to pay the new price, cancel before that renewal and you will not be charged it. A change in the sales tax on a charge is not a price change by us.
9.3 What we owe you on a paid plan
For as long as a plan is paid for, we will provide the weekly allowance, the zip codes per run and per watched item, the watch list items shown each week and the saved-plan period in the table in Section 9.1, and everything else the Service does under Sections 2 and 3. Those are what a plan buys; a plan does not change how long any run takes or when it starts (Section 7). The duties in Section 3.5 apply to every account alike, paid or not.
9.4 Cancelling
Cancel from your account page, in one step. Open your account page, choose “Manage plan”, and cancel. You do not have to email us, phone us, give a reason, or wait for anyone. Deleting your account (Section 8.1) also cancels your plan, and does so before anything else is removed.
When it takes effect. Cancelling stops the plan from renewing. You keep the plan, its allowance and its saved-plan period until the end of the billing period you have already paid for, and your account then continues on the Free plan. Nothing is deleted when a plan ends, and nothing is deleted when you cancel: your account, your lists and your saved plans stay, and saved plans are kept for at most 7 days from the day the paid plan ends (Section 8.1).
No refund for the rest of the month. Because you keep everything you paid for until the period ends, we do not refund the unused part of a billing period when you cancel. The two exceptions are in Section 9.6.
If you cannot cancel from your account page for any reason, write to hello@zipaisle.com from the address your account uses and we will cancel it for you, effective from the date your message arrives.
9.5 If a payment fails
If a monthly charge fails, we keep you on your plan while Stripe retries the card, for up to 7 days. Your account page will tell you the payment is failing and how to update your card. If the payment still has not gone through when the retries end, your plan ends and your account continues on the Free plan. Nothing is deleted, you are not locked out, and you can buy a plan again at any time. We never charge for the days a plan was not in force.
9.6 Refunds, credits, and what is not a refund event
Your first payment is refundable for 7 days. If a paid plan is not for you, write to hello@zipaisle.com within 7 days of your first payment for it and we will refund that payment in full and end the plan. No reason is needed. This applies once per account, to the first payment on your first paid plan; renewals and later plans are not covered by it.
Outages earn a credit, not a refund. If the Service was down or unable to check prices for a substantial part of a week you had paid for, tell us and we will give you a credit against your next charge or a free week, at our choice. Searches that failed were never counted against your allowance in the first place (Section 9.1), so an outage costs you time rather than searches.
What is not a refund event. The following are not failures of a plan and do not entitle you to a refund or a credit, because a plan does not promise otherwise (Section 9.1): a retailer asking us to stop visiting its site and our honoring that request (Section 4.3); a store that declines to show its pages to the Service, or shows them incompletely; a store, area or feature we stop covering (Section 7); a price that was read on an earlier day or was misread (Sections 4.4 and 5); a lookup that came back with no result for an item; and a run that checked fewer items than your list because your allowance ran out.
Nothing in this Section 9.6 limits any right to a refund that consumer-protection law gives you and does not let you waive.
10. Acceptable use
You agree not to:
- (a) use the Service other than as a consumer planning your own household shopping (Section 3.4);
- (b) access the Service by automated means — script, bot, crawler, or agent of your own — or attempt to obtain results in bulk;
- (c) collect, extract, republish, redistribute, or sell the results the Service produces, or use them to build, train, or supplement any database, dataset, model, or commercial product;
- (d) submit requests at a volume or rate beyond ordinary personal use, or attempt to circumvent any limit we apply;
- (e) interfere with, probe, overload, or attempt to gain unauthorized access to the Service or its infrastructure; or
- (f) use the Service to violate any law, or to do indirectly anything these Terms prohibit directly;
- (g) create an account using an email address you do not control, create accounts on anyone else's behalf, or open multiple accounts in order to get around a limit we apply; or
- (h) share your account, or let anyone else use it. Sign-in links and the session they create are personal to you.
We may limit, suspend, or block access for any use we reasonably believe falls outside these Terms.
11. Intellectual property
Ours. The Service — its interface, design, text, the way results are organized and presented, and the software behind it — belongs to us or our licensors. We grant you a personal, limited, non-transferable, revocable licence to use it for your own shopping, and nothing more.
Theirs. Product names, descriptions, images, prices, and store names and marks belong to the retailers and brands that publish them. We claim no ownership of them, and we present them only as the report of what your agent found.
Yours. Your shopping list is yours. We claim no ownership of it and use it only to perform the run you asked for and to operate and improve the Service.
Your feedback. If you rate a plan, or send us an idea, a suggestion or any other comment about the Service, you agree that we may use what it tells us to run and improve the Service, without restriction and without owing you anything for it, and that we are not obliged to act on it. That gives us no rights in your personal information: what you write to us is kept, and erased, as the Privacy Policy says, and we will not publish it, or attribute anything in it to you, without asking you first.
12. Third-party links
Results link out to retailers' websites for your convenience. Those sites are not ours, we do not control them, and their content, terms, and privacy practices are their own.
13. Disclaimer of warranties
To the fullest extent permitted by law, the Service and everything in it are provided “as is” and “as available,” without warranties of any kind, express, implied, or statutory — including any implied warranties of merchantability, fitness for a particular purpose, accuracy, or non-infringement.
Without limiting Section 5: we do not warrant that any price, product match, size, availability, total, or saving reported by the Service is accurate, current, complete, or achievable, or that the Service will be uninterrupted, secure, or error-free.
Some jurisdictions do not allow the exclusion of certain warranties, so parts of this section may not apply to you.
14. Limitation of liability
To the fullest extent permitted by law:
- We are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost savings, lost profits, lost time, wasted trips, or fuel, arising out of or relating to the Service.
- We are not liable for any loss arising from your reliance on a price, product match, availability, total, or saving reported by the Service, including where the actual price at a store is higher than what we showed, where an item is not stocked, or where a store we identified is closed, has moved, or does not exist.
- Our total aggregate liability to you for all claims relating to the Service will not exceed the greater of the amount you have paid us for a plan in the twelve months before the claim or US$100. If you have never paid us anything, that amount is US$100.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited — including liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, or any liability under consumer-protection law that may not be waived. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
15. Your responsibility for the errands you send
You are responsible for the instructions you give the Service. You agree to indemnify and hold us harmless from any claim, loss, or expense (including reasonable legal fees) arising out of:
- (a) your use of the Service in breach of these Terms, in particular the representations in Section 3.4;
- (b) your direction of the Service to a retailer's website in circumstances where your own access would breach an agreement or order binding on you (Section 4.5); or
- (c) your republication, redistribution, or commercial use of results the Service produced for you.
This section does not apply to anything done by the Service outside the scope of what you instructed, and does not shift to you any liability arising from our own acts, our own decisions about which retailers to cover, or our breach of these Terms.
16. Termination
You may stop using the Service at any time; for a run, that ends the appointment, while a watch list ends only when you remove its items or delete your account (Section 3.6). You may cancel a paid plan at any time (Section 9.4), and you may delete your account at any time, and what that removes is set out in Section 8.1 and in the Privacy Policy. We may suspend or end your access, or an account, at any time, with or without notice, including for a breach of these Terms; Section 8.1 says what happens to saved plans when either of us ends an account, and what we refund if we end a paid account without cause. Sections 5, 9.6, 11, and 13 through 19 survive.
17. Disputes and governing law
Talk to us first. If something goes wrong, contact us through the Contact page or at hello@zipaisle.com, and give us 30 days to try to resolve it. Most problems can be fixed this way, and this step costs you nothing.
Governing law. These Terms are governed by the laws of the State of Washington, without regard to its conflict-of-laws rules.
Where claims are brought. Any claim not resolved informally will be brought exclusively in the state or federal courts located in King County, Washington, and both of us consent to the jurisdiction of those courts. You may also bring an individual claim in small claims court if it qualifies.
Consumer rights. Nothing here deprives you of the protection of mandatory consumer-protection laws of the state where you live.
18. Changes to these Terms
We may update these Terms. If a change is material, we will post the updated Terms with a new effective date and, where the change affects the scope of the authority you grant in Section 3, we will bring it to your attention before your next run. A change to the price of a plan, or to what a plan includes, is announced in the way Section 9.2 describes and never takes effect before your next renewal. Continued use after the effective date means you accept the updated Terms. If you do not accept them, stop using the Service and, if you have a paid plan, cancel it.
19. General
Entire agreement. These Terms and the Privacy Policy are the whole agreement between us about the Service.
No waiver. If we do not enforce something, we have not given it up.
Severability. If any provision is unenforceable, it is limited or removed to the minimum extent necessary and the rest stays in force — except that if Section 3 is held unenforceable in its entirety, these Terms terminate, because the appointment is the basis on which the Service acts at all.
Assignment. You may not assign these Terms. We may assign them to a successor in connection with a merger, acquisition, or sale of assets.
No third-party beneficiaries. Except that Section 4.3 may be relied on by a retailer making a request under it.
